Terms of Business
The terms on which Giusto Care Recruitment Ltd supplies healthcare staff to clients.
1. About these terms
These terms apply when Giusto Care Recruitment Ltd (“we”, “us”) supplies or introduces nurses, healthcare assistants, support workers and other healthcare staff (“workers”) to a care home, healthcare provider, other agency or private family (“you”, “the client”). Fees, rates and any special terms are agreed with you in writing before work starts, and those written terms prevail if they differ from this page.
2. Our service
We introduce suitable, vetted workers to you for the shifts and placements you request. We do our best to meet every request but cannot guarantee that a worker will be available for every shift.
3. Vetting and your responsibilities
Before we offer a worker to you we carry out identity, right-to-work, Enhanced DBS, reference, qualification and registration checks (including NMC registration for nurses) and a clinical interview. You remain responsible for your own regulated activity, including:
- giving each worker a proper induction, site orientation and information about the people they will support
- supervising and directing the work on your premises, and providing a safe working environment
- telling us promptly about any safeguarding concern, incident, complaint or performance issue involving a worker
- being registered with the CQC where the law requires it
4. Fees and payment
You will pay our fees at the rates agreed in writing, plus VAT where it applies. We invoice on the basis of approved timesheets. Invoices are payable within the period shown on the invoice. If you do not pay on time we may charge interest and recovery costs under the Late Payment of Commercial Debts (Interest) Act 1998.
5. Timesheets
Your authorised representative approves the worker’s timesheet for each shift. If you dispute any hours, tell us in writing as soon as possible and we will work with you to resolve it. You must pay any part of an invoice that is not in dispute.
6. Cancellations
Please give us as much notice as you can if you need to cancel or change a shift. If you cancel at short notice, a cancellation fee may apply as set out in your agreed written terms.
7. Hiring our workers directly
If you wish to employ or engage a worker we have introduced to you directly, please tell us first. A fee may be payable as set out in your agreed written terms, and you must give us the notice or fee period the Conduct of Employment Agencies and Employment Businesses Regulations 2003 allow.
8. Data protection and confidentiality
Each of us will comply with data protection law when handling personal data about workers and the people you care for. We will only share worker information with you that is relevant to the placement. You must keep worker information confidential and use it only for the placement. See our Privacy & Cookie Policy.
9. Liability
Nothing in these terms limits or excludes liability for death or personal injury caused by negligence, for fraud, or for anything else the law does not allow us to limit. Subject to that, we are not liable for indirect or consequential loss, and our total liability to you for any claim arising from a placement is limited to the fees you paid us for that placement. We hold professional indemnity and public liability insurance.
10. Complaints and general
If you are unhappy with any worker or part of our service, please tell us straight away at hello@grecruit.co.uk or on 07470 403138 and we will look into it promptly. These terms are governed by the law of England and Wales and the courts of England and Wales have jurisdiction. We may update these terms from time to time; the version on this page applies to new bookings from the date shown.
